Welcome to the website of Thomas Jakob Schneider. These General Terms and Conditions (“Terms”) govern the sale of CDs, MP3s, and sheet music through this website. By purchasing products from this site, you agree to be bound by these Terms.

§ 1 Conclusion of Contract

A contract is concluded when you place an order for a product (CDs, MP3s, or sheet music) through this website, and you receive an order confirmation from us via email. The contract is only established once the order confirmation has been sent to you.

§ 2 Payment

All prices listed on the website are final prices, including VAT where applicable. Payments can be made via the payment methods provided on the website, such as PayPal or credit card. Payment is due immediately upon order.

§ 3 Delivery

Physical products (e.g., CDs) will be shipped to the address provided by you during the ordering process. Digital products (e.g., MP3s, sheet music) will be made available for download immediately after the payment is completed.

Shipping costs, if any, are indicated during the checkout process.

§ 4 Right of Withdrawal

Right of Withdrawal for Physical Products

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire 14 days after you receive the physical goods.

To exercise the right of withdrawal, you must inform us of your decision to withdraw from the contract by a clear statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory.

Right of Withdrawal for Digital Products

The right of withdrawal does not apply to digital products (e.g., MP3s, sheet music) once the download has begun, as you have expressly agreed to the commencement of the download and acknowledged that your right of withdrawal will be lost upon the start of the download.

§ 5 Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery (except for any additional costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and no later than 14 days from the day on which we are informed of your decision to withdraw from this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise. You will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the returned goods or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will bear the direct cost of returning the goods.

§ 6 Retention of Title

All goods remain our property until full payment has been made.

§ 7 Liability

We are liable without limitation for damages resulting from injury to life, body, or health caused by us, our legal representatives, or our agents, as well as for damages resulting from intent or gross negligence.

In cases of slight negligence, we are liable only for breach of essential contractual obligations. In such cases, liability is limited to the typical, foreseeable damage.

§ 8 Data Protection

Your personal data will be collected, processed, and used in accordance with our Privacy Policy, which is available on this website. We take the protection of your data seriously and comply with the applicable data protection laws of Germany.

§ 9 Applicable Law and Jurisdiction

The substantive law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the customer is a business entity, the exclusive place of jurisdiction is Aachen.

§ 10 Miscellaneous

If any provision of these Terms is or becomes invalid, the validity of the remaining provisions shall not be affected. Deviating, conflicting, or supplementary general terms and conditions of the customer shall only become part of the contract if we have expressly agreed to their validity in writing.
